  • Is it illegal to rent a basment apartment without rental/lease papers?

Posted by admin on May 12th, 2010 and filed under apartment rental | 2 Comments »

Hey i pay cash every month to rent a Basment apartment is it illegal, if i dont have any lease papers or rental papers or andy recipts?

When you pay your rent. You should do it with a check or money order that is called a paper trail.
Ask for a rental recite of your payment. Even a verbal agreement is fine if you all are under the same understanding. However it only protects you and the owner if it is in writing.

I will be traveling to Peru very soon. Can anyone recommend a safe, trustworthy apartment rental?

I need to rent an apartment for 10 days. Please reply if you have stayed in one and did not experience any problems. Particularly in the area of Miraflores.

My Miraflores apartment is already rented (full furnished) it is well located and it consist of three 15 floor buildings with some facilities like a Gym, Sauna, swimming pool, Fronton Court, snack bar and reunion saloons (one outdoors, one indoors). My 56 square meter apartment has 1 room, 1 bathroom, 1 living-dinning room and a kitchenet and I rent it for US $ 300/month (the use of facilities is charged seperatly).

I called them to ask for an E-mail you can contact, they’re already finding out if there’s a full furnished apartment for rent. But I don’t think they understand English so write them in spanish to : administracion.inrepco@gmail.com

My wife teaches at an Italian school and every year many teachers come from Italy for 2-5 years. They are saying that its not easy to find a place at this moment (there’s a lot of requiring going on) so I’m going to give you a web page where you can also look.

Do apartment/rental housing agency’s have the right to request copies of military orders for breaking a lease?

Posted by admin on May 4th, 2010 and filed under apartment rental | 6 Comments »

My husband received assignment somewhere else and so we had to break our lease early, and the apartment / rental company that leases the property said they needed to have a copy of my husband’s orders and that he could not just show them to the management.

    Is this legal?

Yes… under the Soldiers and Sailors relief act you are entitled to end a lease early, however, you must provide your complex with a copy of deployment orders. Be sure to obtain something in writing that the lease was terminated or they might try to collect on a debt that you should have been out of.

Is it legal to be denied an apartment rental because of marital status?

Posted by admin on April 30th, 2010 and filed under apartment rental | 11 Comments »

My boyfriend and I were recently denied to even view an apartment because the landlord does not allowed unmarried couples to live there. Is this legal? The landlord is amish, but we currently rent from an amish landlord and there are no problems.

Federal Fair Housing laws do not prohibit discrimination on the basis of marital status. However, the state you live in may provide protection. I don’t know where you live, but the Amish population is heavily concentrated in Pennsylvania, Indiana, and Ohio, none of which appear to have laws protecting unmarried couples.

Nonetheless, you should still check into whether your city has an ordinance banning such discrimination.

Can an "As Is" clause in an apartment rental lease relieve a landlord from fixing dangerous conditions?

Posted by admin on April 28th, 2010 and filed under apartment rental | 3 Comments »

I live in New York City and there is an "As Is" clause in my lease that states "tenant shall be responsible for painting, drywall, and other repairs which are deemed necessary by the tenant or any regulating agency which inspects the apartment at tenants request. Including but not limited to broken windows, doors, appliances, base trim, countertops, etc. …" I have an outlet that is shorting and sparking and is a fire hazard. Is the landlord obligated to fix this based on the Warranty of Habitability law or am I responsible?

Why would you sign a lease like that? It takes you from the world of black and white into the various legal shadows of gray.

And what landlord would do this, leaving himself at the mercy of idiot tenants who do repairs with bobby pins and duct tape and slap a coat of paint over it?
